Warranty Certificate
WARRANTY: Coldshield warrants its product(s) against defects in materials and workmanship for a period of 12 months from the date of original retail purchase. Repairs carried out to Coldshield equipment are warranted for three months from the date of the repair service. This Warranty applies only to products that will be identified by the “Coldshield” trade name or logo affixed to them. This Warranty does not apply to product(s) not purchased from a “Coldshield” Distributor or Authorised Reseller, or to products not manufactured by Coldshield. This Warranty is valid only in Australia and New Zealand and is voided if the product’s serial number has been removed or defaced. Only “Coldshield” Authorised service centres are permitted to repair Coldshield products under this warranty. During the warranty period, Coldshield will authorise repair or, at its option replacement of “Coldshield” product(s) at no charge to the Owner should Coldshield find them to be defective, provided, however, that such “Coldshield” product(s) are returned to a “Coldshield” Authorised service centre and the freight and insurance charges are prepaid by the Owner. The Owner must also enclose proof of the date of retail purchase of the product(s), a description of the problem, and contact name, address and telephone number. When the supply of the goods has included installation at the original location. This Warranty does not apply if, after the “Coldshield” product(s) have been damaged by accident, abuse, misuse or misapplication, neglect, or improper installation or as a result of service or modification by other than a “Coldshield” Authorised service centre that affects the reliability and performance of the product(s), not arising from or caused by faulty manufacture of the workmanship. Subject to the following paragraph, the benefits conferred by this Warranty are in addition to all other rights and remedies that a “customer”, as defined in the Trade Practices Act 1974, may have against Coldshield under the Trade Practices Act 1974 and all non-excludable rights and remedies that a consumer may have against Coldshield under similar state or territory laws. To the extent that liability under the Trade Practices Act 1974 or such other State or Territory laws may be limited, the liability of Coldshield thereunder shall be and is hereby limited to replacement or repair of Coldshield products at the sole option of Coldshield. Except as expressly stated in this Warranty and as provided for by the legislation referred to in the following paragraphs, all other Warranties, conditions and liability implied by Stature and by rule of law are hereby expressly excluded and negated, and Coldshield will not accept or have any other responsibility or liability whatsoever, including liability for negligency or liability for incidental, consequential, indirect, or special damages, including, without limitation, lost business profits.
INSTALLATION AND MISUSE: The customer agrees to install and use the goods in accordance with the instructions available from Coldshield on request and with any directions or instructions displayed on or supplied with the equipment. Coldshield is not responsible for any loss or damage incurred or suffered by the customer or by any other person as a result of any incorrect installation, misuse of the equipment or negligence. The customer agrees to indemnify Coldshield against any loss or damage which Coldshield suffers or incurs should any claim or demand be made by any person against Coldshield for any reason whatsoever.
